Who Can File An Ontario Wrongful Death Claim?
California law defines who has the right to file a wrongful death claim. You should consult with an experienced Ontario wrongful death attorney to determine whether you have the right to file a claim.
Generally, the following people may file a wrongful death claim in California:
- The spouse or domestic partner of a wrongful death victim may recover both economic and non-economic damages.
- Children and the issue of deceased children of a wrongful death victim may be entitled to seek compensation. Stepchildren partially financially dependent on the victim may be entitled to file a claim. Additionally, any minor who had resided with the wrongful death victim for at least 180 days before death may have the right to seek compensation if they can prove they were financially dependent on the victim.
