Understanding Liability in a Car Accident
If you are involved in a car accident causing injuries and damages, you can file a personal injury claim to seek compensation for expenses like medical bills and vehicle repairs. However, not everyone involved in a car accident can pursue such claims. You have the right to file a claim if:
- Another party’s wrongful actions caused the accident.
- You suffered injuries in the crash.
- You have evidence to support your claim.
If you are at fault for the collision, you typically cannot pursue compensation for damages. Therefore, when filing a claim, you must prove that your injuries resulted from the other party’s negligence. Note that in personal injury law, negligence in a car accident meets the following elements:
- The other party was responsible for ensuring everyone’s safety on the road.
- They neglected this duty, such as committing a traffic law violation.
- The neglect of duty caused an accident.
- There are injuries and other damages resulting from the accident.
When justifying negligence, you must have the necessary evidence, such as photos of the accident, police report, and witness testimony. A Sutter County car accident lawyer can help examine your situation and use their resources and expertise to collect evidence when protecting your rights.
